1. Acceptance of Terms

By downloading, installing, or using the Locuna mobile application (the “App”), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the App.

2. Description of Service

Locuna provides location tracking services to help small businesses monitor the real-time location of employees, vehicles, or devices for operational purposes. The App is available on iOS and Android and requires network connectivity and permission to access device location data.

3. Eligibility

You must be at least 18 years old to use the App. If you use Locuna on behalf of a business or organisation, you confirm you have authority to accept these Terms on its behalf.

4. Subscriptions and Payments

Locuna offers paid subscription plans. Subscriptions are purchased and managed through the Apple App Store or Google Play Store and are subject to their respective terms, billing practices and refund policies.

By subscribing you authorise billing and accept the pricing, billing cycle, and renewal terms presented at purchase. Continued access to subscription features requires an active subscription; cancelling via the App Store / Play Store will stop future renewals but will not necessarily refund previous charges (see platform policies).

5. Use of the Service

You agree to use Locuna lawfully and responsibly. You are responsible for:

  • Obtaining all legally-required consents from individuals whose locations are tracked.
  • Ensuring the App is not used for unlawful surveillance, harassment, or other prohibited activities.
  • Maintaining the confidentiality of your account credentials.

6. Privacy

Your use of the App is subject to our Privacy Policy, which explains how we collect, use and protect your personal information, including location data.

7. Intellectual Property

All intellectual property rights in the App, including code, designs, trademarks and content, are owned by Sean O'Connor or licensors. You may not copy, modify, distribute or reverse-engineer the App except as permitted in writing.

8. Service Availability & Modifications

The App is provided "as is" and may be modified, suspended or discontinued at any time. We are not liable for interruptions or changes to the service.

9. Limitation of Liability

To the maximum extent permitted by New Zealand law, Sean O'Connor will not be liable for indirect, incidental, consequential or special damages (including loss of profits or data) arising from use of the App. Your sole remedy is to stop using the App.

10. Termination

We may suspend or terminate your access for violations of these Terms or for unlawful use. On termination, your rights to use the App end and we may delete data in accordance with our Privacy Policy and applicable law.

11. Governing Law

These Terms are governed by the laws of New Zealand. Disputes are subject to the exclusive jurisdiction of New Zealand courts.

Privacy Policy

1. Introduction

This Privacy Policy explains how Locuna ("we", "us", "our") collects, uses and protects personal information when you use the Locuna mobile application ("App"). We handle personal information in accordance with the New Zealand Privacy Act 2020 and other applicable laws.

2. Information We Collect

Account Information

When you register or are added to a business account we may collect: name or username, email address, business or team association, and authentication details (e.g., from Apple, Google or Firebase).

Location Data

The App collects device location data (GPS coordinates, speed, timestamps) to provide tracking and history features. Location data is collected only when the App is active or as configured by your organisation. You may disable location permissions in device settings, but some features will be limited.

Usage & Device Data

We collect anonymous usage metrics (feature usage, errors, session durations) and technical device information (OS version, app version, device type) to improve performance and resolve issues.

3. How We Use Your Information

  • Provide, operate and maintain the App.
  • Display and share location information with authorised account members.
  • Communicate updates, security notices and support messages.
  • Detect and prevent abuse, fraud and unlawful activity.

We do not sell or rent personal information to third parties.

4. Data Sharing

We may share data with:

  • Cloud and infrastructure providers (e.g., Firebase, Google Cloud) for hosting and data storage.
  • App Store / Play Store payment processors for subscription management.
  • Law enforcement or regulators when required by law.

Third parties are contractually required to protect data consistent with this Policy.

5. Data Retention

We retain personal information only as long as necessary to provide the service or comply with legal obligations. When no longer required, data will be deleted or anonymised.

6. Your Rights

Under the New Zealand Privacy Act 2020 you have rights to access and correct your personal information and to withdraw consent. Withdrawing consent may reduce or disable App functionality.

7. Data Security

We apply reasonable technical and organisational measures to protect data (encryption, access controls). However, no method of transmission or storage is 100% secure.

8. Children

Locuna is not intended for individuals under 18. We do not knowingly collect data from minors.

9. International Transfers

Your data may be stored or processed outside New Zealand (for example, by cloud providers). We ensure appropriate safeguards are in place to protect your information in accordance with New Zealand privacy standards.

10. Changes to This Policy

We may update this Privacy Policy. The "Last updated" date at the top indicates the current version. Significant changes will be communicated via the App or email.
